Terms of Service

1. Acceptance of Terms

By accessing or using the RESTinCloud website (hereinafter "Site") or the services offered by InCloud S.r.l., the User agrees to be bound by these Terms of Service. If you do not agree with these terms, please do not use the Site and Services.

2. Description of Service

RESTinCloud provides a cloud-based CRM management software (SaaS - Software as a Service) specifically designed for funeral homes. The Service includes features such as OCR document acquisition, order management, memorial card generator, auto-filling forms, and other features accessible upon subscription.

3. Permitted Use

The User agrees to use the Service exclusively for lawful purposes, in compliance with current regulations (including privacy and data protection laws) and these Terms. It is explicitly forbidden to:

• Use the Service in a way that damages, disables, overburdens, or impairs the servers or networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service.
• Upload, post, or transmit illicit, defamatory, obscene content or content that infringes third-party rights.
• Resell, license, or commercially exploit the Service without the explicit written consent of InCloud S.r.l.

4. Registration and Account Security

To access certain features, the User must register an account. The User is responsible for maintaining the confidentiality of their login credentials and all activities that occur under their account. InCloud S.r.l. shall not be liable for any loss or damage arising from the failure to comply with this security obligation.

5. Intellectual Property

All contents present on the Site (texts, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software) are the property of InCloud S.r.l. or its content suppliers and are protected by Italian and international copyright and intellectual property laws.

6. Processing of Personal Data

The use of the Service involves the processing of Personal Data by InCloud S.r.l. The User, acting as Data Controller for their clients' data (e.g., deceased and family members), appoints InCloud S.r.l. as Data Processor, as governed by a specific Data Processing Agreement (DPA) provided during the contract signing phase.

7. Limitation of Liability

InCloud S.r.l. provides the Service "as is" and "as available". To the extent permitted by law, InCloud S.r.l. makes no explicit or implicit warranties regarding the operation of the Site or the information, content, materials, or products included in it. In no event shall InCloud S.r.l. be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Service.

8. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Substantial changes will be communicated via a notice on the Site or by email. Continued use of the Service after any changes take effect constitutes acceptance of the new Terms.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Italian law. For any dispute arising out of or related to these Terms, the Court of Modena shall have exclusive jurisdiction.
